Getsy Terms of Use | User Rights and Responsibilities

1. Acceptance of Terms

By accessing or using the Getsy website ("Platform"), you ("User") agree to comply with these Terms of Service ("Terms"). If you do not accept these Terms in full, you must not use the Platform.

2. Platform Description

Getsy is a digital listing platform for independent sex workers and escort service providers in New Zealand (collectively, "Service Providers") to create profiles.
Getsy does not verify, validate, endorse, or guarantee any content posted by Service Providers.
Getsy solely provides technological means for Service Providers to display profiles and potentially connect with prospective clients. Getsy is not an employer, agent, or representative of any Service Provider.

3. Eligibility & Age Restriction

The Platform is strictly intended for adults aged 18 years or older.
Use of the Platform by minors is expressly prohibited.
Content depicting, advertising, or referencing individuals under 18 years of age is strictly forbidden and will result in immediate removal and possible reporting to law enforcement.

4. No Responsibility for Content

User-Generated Content: Service Providers are solely responsible for all content they post, including profiles, images, statements, and claims.
Verification: Users must independently verify the accuracy, authenticity, and legality of any content found on the Platform.
Disclaimer: Getsy disclaims all responsibility for any errors, omissions, or misrepresentations in user-generated content.
AI-Generated Content: The Platform may include AI-generated content provided by Getsy. This content may be inaccurate or incomplete. Getsy is not liable for any damage or harm resulting from reliance on AI-generated content.

5. AI Chat Companions

Getsy provides access to AI chat companions for virtual interactions. By engaging with AI chat companions, you acknowledge and agree to the following:

User Responsibility: You are solely responsible for all interactions with AI chat companions, including any actions, decisions, or consequences arising from such interactions. This includes, but is not limited to, emotional distress, financial decisions, personal disclosures, or any other outcomes resulting from your chats.
Content Risks: AI-generated content may contain errors, inaccuracies, or material that could be deemed inappropriate, offensive, or unsuitable. Getsy does not guarantee the accuracy, appropriateness, or quality of AI-generated content, and you assume all risks associated with its use.
Personal Data Disclosure: Any personal information you share during chats with AI companions is at your own risk. Getsy is not responsible for the security, use, or exposure of such data, including if it is used to train AI models as outlined in our Privacy Policy.
Chat History: Getsy does not guarantee the retention of chat histories, which may be deleted at our discretion. You are responsible for maintaining any records of your interactions if desired.
No Liability for AI Behavior: Getsy is not liable for any behavior, responses, or actions of AI chat companions, including but not limited to offensive language, inappropriate suggestions, or failure to meet user expectations.
Third-Party Interactions: If AI chat companions reference third-party services, products, or content, Getsy is not responsible for any outcomes resulting from your engagement with such third parties.
Acceptance of Risk: By using AI chat companions, you accept all risks associated with their use. If you are unwilling to assume full responsibility for your interactions, you must not use Getsy’s AI chat services.

6. Prohibited Activities

Users agree not to:

Upload or share any content involving minors (under 18), non-consensual or exploitative activities, or content in violation of the Prostitution Reform Act 2003 or other applicable laws.
Post or facilitate any illegal services, including unprotected sexual services, content referencing natural/unprotected services, or any offerings that breach New Zealand law.
Engage in fraudulent, deceptive, or misleading conduct.
Use the Platform in violation of any law, regulation, or third-party right.
Utilize the Platform if you are under 18 or otherwise legally restricted from engaging with adult-oriented content.
Distribute malicious software, spam, or any content that disrupts the Platform’s functionality.
Reproduce, duplicate, copy, sell, trade, or resell the Platform’s materials or code without Getsy’s prior written consent.
Use AI chat companions to engage in illegal activities, share illegal content, or facilitate any behavior that violates these Terms or applicable laws.

7. Removal of Content & Account Termination

Removal: Getsy may remove or modify content and profiles, including AI chat interactions, at any time, for any reason, with or without notice.
Termination: Getsy may suspend or terminate any User’s access to the Platform, including access to AI chat companions, without liability or obligation to the User.
Cooperation with Authorities: Getsy reserves the right to cooperate with law enforcement or other government agencies regarding any content, including AI chat interactions, that may violate applicable laws.
No Obligation to Refund: If content is removed or an account is terminated, Getsy has no obligation to refund any fees paid.

8. Disclaimer of Liability & No Warranties

As-Is Basis: The Platform, including AI chat companions, is provided "as is" and "as available." Getsy makes no representations or warranties of any kind, express or implied, regarding the Platform or its features.
No Warranties: Getsy disclaims any warranty of accuracy, fitness for a particular purpose, security, or non-infringement for the Platform and AI chat companions.
Assumption of Risk: Users assume all risks associated with using the Platform, including interactions with AI chat companions. This includes, but is not limited to, risks of emotional distress, financial loss, data exposure, or any other harm resulting from AI interactions.
Exclusion of Damages: Under no circumstances will Getsy be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to the use of the Platform, including AI chat companions, or any content posted on it. This includes damages resulting from inappropriate AI responses, data breaches involving chat data, or reliance on AI-generated content.
No Liability for Transactions: Getsy has no responsibility or liability for any transactions or interactions, whether conducted on the Platform or elsewhere, between Users and Service Providers, or between Users and AI chat companions.
User Accountability: By using the Platform, including AI chat companions, you acknowledge that you are solely responsible for your interactions and any consequences thereof. If you are unwilling to accept full liability for your use of the Platform, you must not use Getsy’s services.

9. Payments & Refunds

Non-Refundable Fees: Any fees paid to Getsy, including for access to AI chat companions, are non-refundable, unless otherwise determined at Getsy’s sole discretion.
Pricing Changes: Getsy reserves the right to introduce or modify fees at any time, with or without prior notice.
Violation of Terms: If a User violates these Terms, or if Getsy removes content or profiles, Getsy is under no obligation to issue refunds.
Third-Party Processors: Payments may be processed through third-party providers; Getsy does not store or handle credit card details directly.

10. User Obligations & Indemnification

Compliance: Users agree to comply with all applicable laws, regulations, and these Terms when accessing or using the Platform, including interactions with AI chat companions.
Indemnification: Users agree to indemnify, defend, and hold harmless Getsy, its officers, directors, employees, and agents from all liabilities, claims, damages, costs, and expenses (including legal fees) that arise from or relate to: (a) any use or misuse of the Platform, including AI chat companions; (b) any breach of these Terms; (c) any content posted or actions taken, including during AI chats; or (d) any interaction between Users, Service Providers, or AI chat companions.

11. Third-Party Links & Services

No Endorsement: The Platform, including AI chat companions, may display or link to third-party websites or services. Getsy does not endorse or assume responsibility for any third-party content, products, or services.
User Risk: Accessing third-party links is done at the User’s own risk.

12. Reporting & Complaints

Reporting Mechanism: Users may report profiles, content, or AI chat interactions they believe to be in violation of these Terms or applicable law. Getsy may investigate the report and take appropriate action.
No Obligation: Getsy is not obligated to mediate or resolve disputes between Users, between Users and Service Providers, or between Users and AI chat companions.
Law Enforcement: If content or conduct, including AI chat interactions, is suspected to be illegal, Getsy may refer the matter to law enforcement or other appropriate authorities.

13. Notification of Claims of Infringement

Intellectual Property: If you believe your intellectual property rights have been violated, please notify us at the contact information below.
Removal: Getsy may remove or disable access to allegedly infringing material upon receiving a proper notice.
Counter-Notification: If your content is removed due to an infringement claim, you may submit a counter-notification that meets applicable legal requirements.

14. Privacy & Data Disclosure

Privacy Policy: By using the Platform, Users consent to Getsy’s data collection and handling practices as described in the Privacy Policy, including with respect to AI chat companions.
Disclosure: Getsy may disclose User information (including IP addresses, timestamps, and other data, such as AI chat interactions) to comply with law enforcement requests, legal obligations, or to protect the safety and rights of Users and the public.

15. ID Verification

No Formal Verification: Getsy does not routinely verify the identity or age of Service Providers or Users beyond the representations they make.
User’s Responsibility: Users are responsible for confirming the identity and age of any individual with whom they engage.
Removal & Reporting: If Getsy suspects or becomes aware of underage content or fraudulent identity use, Getsy may remove such content and report it to law enforcement.

16. Updates to Terms

Right to Modify: Getsy reserves the right to modify these Terms at any time, at its sole discretion.
Notice & Acceptance: Continued use of the Platform following the posting of any changes constitutes acceptance of those changes.

17. Governing Law & Dispute Resolution

Jurisdiction: These Terms are governed by the laws of New Zealand.
Dispute Resolution: Any disputes must be resolved under the exclusive jurisdiction of New Zealand courts.

18. Proprietary Rights & License

Platform Ownership: All rights, title, and interest in and to the Platform (including software, text, and design) are owned by Getsy.
User License: Users receive a limited, non-exclusive, revocable license to access the Platform for personal use only.
User-Submitted Content: By submitting content to the Platform, including during AI chat interactions, Users grant Getsy a worldwide, royalty-free, non-exclusive license to use, distribute, reproduce, modify, and publicly display such content for the purpose of operating the Platform.

19. Entire Agreement

Complete Understanding: These Terms, along with any referenced policies (e.g., Privacy Policy), constitute the entire agreement between the User and Getsy regarding use of the Platform.
Severability: If any provision is deemed invalid or unenforceable, all remaining provisions remain in full force and effect.
No Waiver: A delay or failure by Getsy to exercise any right does not constitute a waiver of that right.
